Intellectual Property Regime Review Welcomed By FAST

UK Government announces a new legal framework for the protection of intellectual property rights in a move seen as a positive step by the Federation Against Software Theft
The Federation Against Software Theft (FAST) welcomes the announcement made by the Coalition on the 4th November 2010 that it intends to conduct a review into the current UK intellectual property regime.

John Lovelock, chief executive, FAST, stated: "In a major speech yesterday, Prime Minister David Cameron announced his intention to see the birth of a technology hub right in the heart of London, stretching from Old Street in the City to the new Olympic Park in the East. At the heart of this initiative will be a fundamental review of the existing IP framework.

"FAST firmly believes that with the right legal framework, with the importance and protection of IP rights at its heart, innovation and entrepreneurialism will accelerate economic growth and commercial innovation. As a long established industry body we intend being at the table taking a material part of any discussions going forward for the benefit of members."

In his speech the Prime Minister stated: "…our ambition is to bring together the creativity and energy of Shoreditch and the incredible possibilities of the Olympic Park to help make East London one of the world's great technology centres…..we are reviewing our IP laws, to see if we can make them fit for the internet age. I want to encourage the sort of creative innovation that exists in America."

Stakeholders including FAST have been contacted by the Department for Business, Innovations and Skills and are being encouraged to participate in the consultation process. According to communication issued to stakeholders yesterday it is expected to focus on the following areas:

* "Identification of barriers to growth in the IP system, and how to overcome them;
* How the IP framework could better enable new business models appropriate to the digital age.
* IP and barriers to new internet-based business models, including information access, costs of obtaining permissions from existing rights-holders, and investigating what are the benefits of "fair use" exceptions to copyright and how these might be achieved in the UK;
* The cost and complexity of enforcing IP rights within the UK and internationally;
* The interaction of the IP and Competition frameworks;
* The cost and complexity to SMEs of accessing IP services to help them to protect and exploit IP."*

John continued: "The Review is expected to make recommendations on how the IP system nationally and internationally can best work to promote innovation and growth in the age of the Internet as well as on what short to medium term measures can be taken now."

"FAST intends to take an active and positive role for the software industry to encourage investment and growth in high technology here in the UK. This has the potential to be a critical plank in the future growth of the UK's Innovation and IP economy and with it our future economic success through increased employment and entrepreneurship of world-renowned brand names. I just hope it does not become another talking shop!"

The Review will report to the Secretary of State for Business, Innovation and Skills and to the Chancellor of the Exchequer, by April 2011.
